Idaho State Public Defender

The Idaho State Public Defender office provides holistic legal representation meeting the highest ethical and professional standards to protect the rights of people who cannot afford to retain counsel.

When Idaho Governor Brad Little signed House Bill 735 in 2022, it moved all financial and legal responsibility for public defense in criminal cases from Idaho’s 44 counties to the State of Idaho.

Governor Little and the Idaho Legislature established the Idaho State Public Defender agency in 2023 to unite and manage all public defense in the state and appointed former Idaho State Public Appellate Defender Eric Fredericksen to lead the effort.

Combining all public defense under a single agency will create efficiencies in the system and establish a state-wide system of professional standards to help ensure any person who is charged with a crime in Idaho who cannot afford a defense attorney gets a robust and professional legal defense.

Every employee of the State Public Defender will work to ensure all criminal defense supports a fair and just legal defense system that values the humanity and dignity of all.

Meet Eric Fredericksen

Governor Little appointed Eric Fredericksen as Idaho’s State Public Defender in the fall of 2023. Eric now manages the state-wide network of county employees and contractors who provide indigent public defense across Idaho.

Eric is an Idaho native who grew up in Jerome and earned his law degree from the University of Idaho in 2002. Eric has been a practicing attorney in the state for over 20 years, having spent much of his career working for Idaho’s State Public Appellate Defender office, representing indigent defendants who had been convicted of felonies who appealed their cases.

Eric took over as Idaho’s State Appellate Public Defender in 2016 for Sara Thomas, who was appointed Idaho’s Administrative Director of Courts. Eric also served as the chairman of the Idaho Criminal Justice Commission from 2019 to 2022.

Eric now runs Idaho’s indigent criminal defense system. The State Public Defender’s office has approximately 300 employees and contracts with over 100 attorneys across the state to provide public defense for indigent Idahoans.
