Capital Case Policy

The State Public Defender Office has adopted a policy for what requirements attorneys must have to represent a client in a capital case – where someone is charged with a crime that could be punished by the death penalty in Idaho.

The SPD followed the American Bar Association (ABA) and National Legal Aid and Defender Association (NLADA) guidelines to create the policy. Attorneys interested in becoming capital-qualified counsel can review our policy here.

The SPD is currently accepting applications from attorneys who want to get capital qualified for criminal defense.

While our agency is developing an internal roster of capital-qualified attorneys, we also have a need for contract attorneys if our agency has a conflict or a case is charged in a county without an SPD office.
